Welcome to Kalir Farm Market. These Terms of Use (“Terms”) govern your access to and use of the website located at www.kalirfarmmarket.com (the “Site”) and your purchase of products from Kalir Farm Market (“Kalir Farm Market,” “we,” “us,” or “our”). By accessing or using the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Eligibility

You must be at least 18 years of age, or the age of majority in your state of residence, to place an order through the Site. By using the Site, you represent that you meet this requirement and that the information you provide is accurate and complete.

2. Products, Orders, and Pricing

We offer farm-grown dried fruit and related food products. We strive to describe and display our products accurately, but we do not warrant that product descriptions, images, or other content are complete or error-free. Colors and packaging may vary.

All prices are listed in U.S. dollars and are subject to change without notice. Placing an order constitutes an offer to purchase. We reserve the right to accept, decline, limit, or cancel any order at our discretion, including after an order has been submitted. Payments are processed securely by our third-party payment processor, Square. We do not store your full payment card details on our servers.

3. Shipping

Shipping terms, costs, and timeframes are described on our FAQ page. Risk of loss passes to you upon delivery to the carrier. We currently ship only within the continental United States.

4. Returns and Refunds

Because our products are perishable food items, returns and refunds are governed by our Refund & Return Policy, which is incorporated into these Terms by reference.

5. Intellectual Property

All content on the Site, including text, graphics, logos, images, and the “Kalir Farm Market” name and branding, is owned by or licensed to us and is protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any content without our prior written permission.

6. Acceptable Use

You agree not to:

  • Use the Site for any unlawful or fraudulent purpose;
  • Attempt to gain unauthorized access to the Site, its servers, or any associated systems;

To the fullest extent permitted by law, Kalir Farm Market and its owners, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Site or products. Our total liability for any claim arising out of or relating to these Terms or your purchase will not exceed the amount you paid for the product giving rise to the claim.

9. Indemnification

You agree to indemnify and hold harmless Kalir Farm Market from any claims, damages, liabilities, and expenses arising out of your misuse of the Site or your violation of these Terms.

10. Governing Law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws principles. Any dispute arising under these Terms will be subject to the exclusive jurisdiction of the state and federal courts located in New York.
